Sexual Child Abuse "Ruled Out" After Winning Administrative Hearing and Confirmed After Appellate Review to Anne Arundel County Circuit Court And To The Maryland Court of Special Appeals

Client is a neighbor of a teenage boy who accused him of sexually molesting him several times and exposing himself to the boy. The resulting DSS investigation determined that our client committed “child sex abuse” and ordered his name to be placed on their registry. He appealed that finding to the Office of Administrative Hearings. At that hearing, we demonstrated that the accuser had provided at least four different versions of the events and we essentially challenged the jurisdiction of DSS to order our client to register. In reversing the DSS finding, the Judge determined that DSS did not prove that our client fell under the applicable statute. The judge changed the DSS finding, concluding that sexual child abuse was “ruled out.”

DSS then appealed the administrative judge’s ruling to the circuit court. We again won in the circuit court. DSS then appealed the circuit court judge’s ruling to the Maryland Court of Special Appeals. After a hearing before a three judge appellate panel, our clientprevailed again.

Client is the step-father of a 15 year old girl who accused him of sexual molesting her numerous times. The resulting DSS investigation determined that our client committed “child sex abuse” and ordered his name to be placed on their registry. He appealed that finding to the Office of Administrative Hearings. At that hearing, we demonstrated that the accuser had motive to fabricate the events due to ongoing custody issues and her unwillingness to be disciplined by her step-father. In reversing the DSS finding, the Judge determined that the accuser’s accusations “lack both specificity and credibility.” The judge changed the DSS finding, concluding that sexual child abuse was “ruled out.”
